Terms of Service
1. General Provisions
- These Terms of Service (“Terms”) set out the rules for using the website available at redcachalot.com (the “Website”) and the rules for providing services by electronic means, in accordance with Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
- The Website is operated by Oleksii Smirnov (RedCachalot Digital Studio), based in Krakow, Poland, Tax ID (NIP): 9452293436 (the “Service Provider”).

- By using the Website, you accept these Terms.
- The Privacy Policy, which describes how personal data and cookies are processed, forms an integral part of these Terms.
2. Services provided by electronic means
- Through the Website, the Service Provider offers the following services free of charge:
- access to Website content (portfolio, blog, service descriptions);
- contact form and project quote form (brief);
- newsletter (subject to separate consent).
- Design and development services (websites, online stores, brand identity, graphic design, photo editing, video production) are provided under separate agreements concluded individually with each client.
- Content presented on the Website, including indicative prices, does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude a contract (Article 71 of the Civil Code).
3. Technical requirements
- Using the Website requires a device with Internet access and an up-to-date web browser with JavaScript and cookies enabled.
- Using the forms and the newsletter requires an active e-mail account.
4. Conclusion and termination of electronic service agreements
- The agreement for access to Website content is concluded when you enter the Website and terminates when you leave it.
- The agreement for the form service is concluded when the form is submitted and expires when the Service Provider replies.
- The newsletter agreement is concluded upon subscription and may be terminated at any time via the unsubscribe link included in every message or by contacting the Service Provider.
5. Prohibition of unlawful content
Users must use the Website in accordance with the law and good practice. In particular, the following are prohibited: submitting unlawful content, sending spam via the forms, and any actions that interfere with the operation of the Website.
6. Complaints
- Complaints regarding the operation of the Website and electronic services may be submitted to: redcachalot@gmail.com.
- A complaint should include: full name, e-mail address and a description of the issue.
- Complaints are handled within 14 days of receipt; the outcome is sent to the e-mail address provided.
7. Personal data
The controller of the personal data of Website users is the Service Provider. Detailed information on the purposes, legal bases, retention periods and user rights (under the GDPR) is provided in the Privacy Policy.
8. Intellectual property
- All content published on the Website (texts, graphics, logos, photos, projects presented in the portfolio) is protected by copyright and belongs to the Service Provider or is used with the consent of its owners.
- Client logos and trademarks shown in the portfolio belong to their respective owners and are used solely to present completed projects.
- Copying or distributing Website content without the Service Provider’s consent is prohibited, except for permitted use provided for by law.
9. Liability
- The Service Provider exercises due care to keep the Website available and functioning correctly, but does not guarantee uninterrupted availability (e.g. due to maintenance or failures beyond the Service Provider’s control).
- The Service Provider is not responsible for the content of external websites linked from the Website.
10. Out-of-court dispute resolution
A user who is a consumer may use out-of-court complaint and redress procedures, including the assistance of municipal (district) consumer ombudsmen or provincial inspectorates of the Trade Inspection in Poland. Details: www.uokik.gov.pl.
11. Final provisions
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means and the GDPR.
- The Service Provider may amend these Terms for important reasons (changes in law, changes in the scope of services). The current version of the Terms is always available on the Website.
- Nothing in these Terms excludes or limits consumer rights arising from mandatory provisions of law.
